Simplifying a complex process with divorce lawyers

Divorce law can be a complex and timely process under Australian law, in particular when assessing additional factors such as child custody. In order to make the process less stressful and challenging, engaging a professional divorce lawyer in Sydney is highly favourable. If you are going through a divorce or separation, a lawyer can help advise you of your rights and make sure you get all you are entitled to. In addition, divorce lawyers will assist through de-clouding visions and decisions which may be affected by emotional stress, and focus on successfully achieving clients’ most desired outcome.

The process of a divorce includes:

  • Separation

The initial separation can be the most difficult time during the divorce as the couple mutually decides that their marriage has come to an end. This is usually followed by one person moving out of the family home, or alternatively, both veering in totally opposite directions. The separation usually takes up to a year before a couple can proceed to the next stage.

  • Application process

Applications for divorce also include a number of other documents which need to be presented to the Court in order to qualify for a divorce. Presenting documents such as a marriage certificate and additional paperwork can be quite a lengthy process and take up to 8 months, or longer, without the assistance of a lawyer.

  • Court Hearing

A lawyer will attend Court on the hearing date and represent the party of the case in which they are handling. In some cases, parties may not be required to attend Court unless they wish to do so. The only circumstances which require parties to attend court will be if there is a child of the marriage under 18 years of age, and the application is a “sole” not “joint” application. If either party has filed a Response to Divorce, it may even be granted in the absence of the opposing party.

  • Divorce Order

The final stage of a divorce is when the Court issues something called a ‘Divorce Order’ which means your marriage has been dissolved and no longer requires you or your spouse to provide further documents or attend Court hearings. This process usually takes one month and one day after your Court hearing.
